Choosing a Beit Din in a Dispute Between a Tenant and a Landlord

Hello.
In a dispute between a tenant and a landlord regarding upon whom the obligation to pay rests, who is considered the claimant with respect to choosing the Beit Din?

Answer

Hello and blessings.
It depends on whether this is before the rent has been paid or after it has been paid. After the rent has been paid, the tenant is making a claim against the landlord to pay; but if he has not yet paid, he may withhold the rent money until the landlord pays. It therefore emerges that the landlord is the claimant.
