Benefiting on Motzaei Shabbat from the act of a Jew who did not make Havdalah
Question
How is it permitted to benefit from work performed by Jews who do not observe Torah and mitzvot and do not make Havdalah on Motzaei Shabbat? Seemingly, on a rabbinic level, the sanctity of Shabbat remains upon them and they are forbidden to perform melachah from the time they became adults and obligated in mitzvot until, many years later, they repent and make Havdalah. For example, traveling with a taxi driver, or dealing with store owners who are tinokot shenishbu; nevertheless, they have not fulfilled the mitzvah of Havdalah?
Answer
Shalom u’vracha.
The driver is obligated to make Havdalah, and he will be held accountable for not having made Havdalah.
Nevertheless, there is no prohibition for another person to benefit from an action performed on Motzaei Shabbat by a Jew who is obligated in Havdalah and did not make Havdalah.
