Filing a claim in civil court

Question

He purchased an apartment from a secular contractor, and the contractor delayed handing over the apartment. All the buyers are joining together to sue him in court. Is it permitted to join them?

Answer

Shalom u’vracha.

You must first offer him to come to a Beit Din, and if he refuses, it is permissible to join the claim in civil court.
