Approaching Courts - Under Threat of Lawsuit

Question

Hello, my estranged wife is threatening to sue me for alimony, custody, and more in court. My lawyer says that if we file the lawsuit first, we have a better chance of success. Is there a prohibition against approaching secular courts?
