Open Pool at Kinar Hotel - Cancellation of Vacation

Question

I booked a vacation at the Kinar Hotel, and now it has come to light that the hotel pool is visible from the hotel rooms. The hotel management admits that this is indeed the case, as can be seen in the attached photos taken from inside the rooms. However, they are refusing to fix the issue, only saying that they may consider addressing it in the future.Am I allowed to cancel my reservation unilaterally, given that I booked based on their advertisement that the hotel is suited for a Torah-observant public? On the other hand, they claim that there is no halachic problem with the pool being exposed (even during women's swimming hours), and that it's my responsibility to avoid looking. Is it really permitted for a pool to be openly visible, with the responsibility placed on the one affected to distance himself and avoid looking at women swimming?

Answer

Shalom Uv'Racha,

HaGaon Harav Amrom Fried shlit”a ruled:

This breach certainly needs to be corrected.

However, since it already existed before you booked the vacation, it cannot be grounds for cancellation against the hotel's policies.
