Using uncertified water heater on Shabbos

Question

Is it permissible to use a water heater with a thermostat on Shabbos? I’m talking about a regular water heater without a kashrut certification, and without a "Shabbat mode" button.

It's forbidden to use a water heater without a switch that turns on 'Shabbos mode'. Since there is no 'Shabbos mode', the thermostat is not disconnected, and whenever water is taken out of the water heater, this could potentially turn the heating element on or off.
