A question about extending a balcony above a neighbor’s living room window

Question

I want to build a balcony two meters wide that extends out in front of both my living room and kitchen, and I’ve already received a permit from the city for it.My downstairs neighbor claims that such a large balcony blocks the light from his living room, and he’s asking that I only build the balcony across from my kitchen. What am I obligated to do according to halacha, and what would be proper lifnim mishurat hadin (beyond the strict letter of the law)? It’s worth noting that this neighbor could also build his own balcony the same size and even add even more space to use for a sukkah if he wanted to.

Answer

Shalom uVracha,

It’s clear that a question like this can’t really be answered on such a platform. One would need to come to the location and see the situation firsthand, and of course, to hear both sides.

Usually, a Beis Din has experts who deal with issues of light and shade, and they would give their professional opinion for the Beis Din to decide accordingly.
