Do I have to pay the synagogue?

Our synagogue serves treats for Simchas Torah. For this purpose, I bought several cartons of cookies from a catering service, and also a carton of filled pastries. In the morning of Simchas Torah, I opened the carton, only do discover that the pastries have become spoiled. I turned to the seller, but he claims that I should have refrigerated the pastries.
So, my question is this. Does not putting the pastries in a refrigerator constitute causing damage to the synagogue property? Do I have to pay for the pastries?

If the cakes weren’t in a place where they were likely to become spoiled, such as a very hot place, you weren’t supposed to think that they’ll go bad. You don’t have to pay.
