A "Chutsnik" in israel over Pesach and diffrent time zones regarding Mechirat Chamets

Question

Hey, gonna be in Israel for Pesach! What are the dos and don’ts halacha-wise? ????????✡️????

Answer

Thank you for your question.

Absolutely! We’ll study the Halachot that you will need to know for the upcoming Yom Tov.

According to halacha, you are obliged to observe all the mitzvot of Yom Tov Sheni in Eretz Yisrael. The source of this halacha is in Orach Chayim, siman 496, seif 13:

משנה ברורה על שולחן ערוך אורח חיים הלכות יום טוב סימן תצו סעיף ג

ובן חו"ל שבא לא"י אם דעתו לחזור למקומו צריך לעשות שני ימים יום טוב.

And a person from outside of Israel who comes to the Erets Yisrael, if he intends to return to his place, he needs to observe two days of Yom Tov.

Asking an Israeli to do a melacha

Even though the people around you will not be observing Yom Tov Sheni, nevertheless, one shouldn’t ask them to perform a melacha for you (similar to the prohibition of Amirah Le'Akum). However, in a time of need (בשעת הדחק), one may be lenient and ask them to perform a melacha for you.

Organizing a Chutsnik Miyan

There is an interesting halacha that although a Ben Eretz Yisrael cannot form a minyan in Chutz La'aretz, a Ben Chutz La'aretz in Eretz Yisrael, like you, may form a minyan for Bnei Chutz La'aretz on Yom Tov Sheni. This is based on the ruling of the 'Shut Avkas Rochel’, teshuvah 26. He writes as follows:

And not only that, but they gather a minyan of people from outside Israel who come for the Yom Tov and they pray, read from the Torah, and recite the Haftarah with the blessings before and after, just as is done on the second day of Yom Tov in Chuts le’orets. This practice has been done since ancient times in the presence of the great leaders of the world, and no one has ever doubted this practice... And how do we not worry about what we learned, that a person should not deviate due to disputes... We must say that it seemed to the Chachamim that the teaching, 'a person should not change due to disputes,' applies only to melacha Etc. which may lead to the desecration of the Yom Tov, but with prayer, even if one prays according to the custom of the place he left, it will not cause any desecration to Yom Tov.

Receiving an Aliyah

The rule about receiving an Aliyah, even though it is not the same keriah as yours, is as follows: whenever it’s a day that in Eretz Yisrael they read from the Torah—for example, on Chol Hamoed or even the day after Yom Tov, which may be a Monday or Thursday—then you may receive an Aliyah, even though it is not the same kriyah that you would have had to read.

Selling the chomets

There is a big debate among the Poskim (Oneg Yom Tov Siman 36, and the Chessed Le’avraham) in a case like yours, where the chametz and the owner are located in two different time zones. The question is: according to which time zone should one sell the chametz? Is it where the chametz is located, or is it based on the owner's location? Therefore, Hagaon Harav Amrom Fried Shlit"a says that one should sell the chametz at the earliest possible time, based either on the location of the chametz or the owner, and repurchase it at the latest possible time.

Wishing you a Chag Kasher Ve’Sameach.
